On March 4, 2026, a presentation of the collective monograph "Scientific Concept of the Development of Ukrainian Legislation" took place at the Constitutional Court of Ukraine, prepared by the Institute of Lawmaking and Scientific-Legal Expertise of the National Academy of Sciences of Ukraine with the participation of leading Ukrainian legal experts.
The event was attended by judges of the Constitutional Court of Ukraine, members of the Scientific Advisory Council under the Chairman of the Verkhovna Rada of Ukraine, representatives of the National Academy of Sciences of Ukraine, as well as scholars from leading Ukrainian law schools.
This event became the first joint event of the Constitutional Court of Ukraine and the National Academy of Sciences of Ukraine dedicated to discussing the conceptual foundations for the development of national legislation.
Opening the event, Acting Chairman of the Constitutional Court of Ukraine Oleksandr Petryshyn welcomed the participants and emphasized the importance of a systematic scientific approach to the development of legislation. According to him, Ukrainian legislation is often characterized by inconsistency and contradictions, so the formation of a scientific concept for its development is a necessary condition for improving its quality and coherence.
Vice President of the National Academy of Sciences of Ukraine Oleh Rafalskyi in his speech emphasized that law is the fundamental basis for the existence of the state, especially in the face of modern challenges. He noted that the Constitutional Court of Ukraine not only applies the law but also acts as an active participant in the lawmaking process. According to him, it is the scientific approach that is the methodological tool that allows improving the quality and effectiveness of legislation. Special attention was paid to the role of the National Academy of Sciences of Ukraine in the lawmaking process, since according to the Law of Ukraine "On Lawmaking Activity," the NAS of Ukraine is designated as one of the key entities conducting independent scientific expertise of draft laws and forecasting the development of legislation.
Director of the Institute of Lawmaking and Scientific-Legal Expertise of the NAS of Ukraine Oleksii Kot in his speech outlined the prerequisites for preparing the monograph and drew attention to the need to form a comprehensive scientific doctrine for the development of legislation.
The presentation part of the event was moderated by Constitutional Court judge Oksana Hryshchuk and Director of the Institute of Lawmaking and Scientific-Legal Expertise of the NAS of Ukraine Oleksii Kot.
A substantive report was delivered by Deputy Chair of the Scientific Advisory Council under the Chairman of the Verkhovna Rada of Ukraine Nataliya Kuznetsova, who was one of the main initiators of the monograph’s preparation and spoke about the idea behind this large-scale study. She noted that most of the authors of the publication are members of the Scientific Advisory Council under the Chairman of the Verkhovna Rada of Ukraine, representing various scientific schools and regions of the country. According to Nataliya Kuznetsova, representatives of leading law universities and scientific institutions of Ukraine were involved in the work on the monograph. She expressed special gratitude to the Institute of Lawmaking and Scientific-Legal Expertise of the NAS of Ukraine, which provided organizational and scientific coordination of the authors’ collective work. The report outlined the theoretical and practical foundations for forming the Concept, its significance for the development of legislation, as well as possible models for implementing the findings in the activities of state authorities.
Director of the Educational and Scientific Institute of Law of Taras Shevchenko National University of Kyiv Oksana Vasylchenko in her report focused on the constitutional foundations for the development of Ukrainian legislation. In her speech, she emphasized the key role of the Constitution of Ukraine as the system-forming foundation of all lawmaking activities of the state.
Constitutional Court judge Serhii Riznyk also delivered a report, focusing on the importance of scientific research for the development of the modern legal system and the improvement of lawmaking activities. In his speech, he stressed that the formation of effective and coherent legislation requires a systematic scientific approach as well as close interaction between the scientific community, lawmakers, and constitutional jurisdiction bodies.
In the speech of Deputy Director for Scientific Work of the Institute of Lawmaking and Scientific-Legal Expertise of the NAS of Ukraine Andrii Hryniak, attention was drawn to the preparation of concepts for the development of sectoral legislation, on which the Institute is currently working within the framework of the implementation of the targeted scientific program of the NAS of Ukraine. He noted that the relevant research aims to form a systemic vision for the modernization of specific branches of law, improve regulatory frameworks, and develop scientific forecasts for the further development of legislation. According to the speaker, one of the key tasks of these efforts is to ensure coherence and systematic legal regulation, as well as harmonization of national legislation with European legal standards.
Deputy Director of the V. M. Koretsky Institute of State and Law of the NAS of Ukraine Nataliya Onishchenko, who is one of the authors of the presented monograph, also addressed the audience. In her speech, she highlighted the importance of legal science in forming strategic guidelines for the development of national legislation. Nataliya Onishchenko noted that the preparation of scientifically grounded concepts for the development of legislation is a necessary prerequisite for ensuring its coherence and effectiveness. She emphasized that such fundamental research contributes to the formation of a modern legal doctrine and strengthens interaction between science, lawmaking practice, and state institutions.
After the presentation of the monograph, a lively scientific discussion took place, involving judges of the Constitutional Court of Ukraine, well-known Ukrainian legal experts, and scholars.
